1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Spellstash, the website at spellstash.com and all related products and features (collectively, the "Service"). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. We may update these Terms from time to time; continued use of the Service after an update constitutes acceptance of the revised Terms.

2. Description of Service

Spellstash is a card-location tracker for Magic: The Gathering players. The Service lets you create containers (decks, boxes, binders, and similar), record physical card instances within those containers, move instances between containers, and search across your full collection to locate any card. Spellstash is offered in two tiers: a Free tier and a paid Pro tier, each with the limits described on the homepage and on this page in Section 7. Card data shown in the Service is sourced from third-party providers including Scryfall and may be incomplete, delayed, or contain errors.

3. User Accounts

To use most features of the Service you must create an account using either email-and-password or Google sign-in. You must be at least 13 years of age (and the age of majority in your jurisdiction for binding contracts) to create an account. You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity that takes place under your account. Notify us at info@spellstash.com promptly if you suspect unauthorized use of your account. One person, one account; do not share account credentials.

4. Acceptable Use

You agree not to:

  • Use automated tools, bots, scrapers, crawlers, or similar technology to access, extract, or index data from the Service without our prior written consent
  • Attempt to gain unauthorized access to any portion of the Service, its underlying systems, or its networks
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Interfere with or disrupt the operation, integrity, or security of the Service or any data hosted by the Service
  • Attempt to reverse-engineer, decompile, or disassemble any portion of the Service
  • Reproduce, redistribute, or resell data obtained from the Service for commercial purposes without our written consent
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Upload or transmit viruses, malware, or other harmful code through the Service
  • Exceed reasonable usage limits, abuse rate-limited endpoints, or attempt to circumvent tier limits

5. Data Accuracy and Availability

We make no warranty regarding the accuracy, completeness, reliability, or timeliness of any card data, set data, image, or related content displayed in the Service. Card data is sourced from third-party providers (including Scryfall) and may be incomplete, delayed, or contain errors. The Service may experience downtime or interruptions due to maintenance, third-party API limitations, network conditions, or other factors outside our control. We do not warrant continuous, uninterrupted, or error-free operation.

6. Intellectual Property

The Service — including its design, code, text, graphics, logos, and the selection and arrangement of all of the foregoing — is owned by Spellstash and is protected by copyright, trademark, and other intellectual property laws. Magic: The Gathering and all card names, card images, card text, set names, and related trademarks are the property of Wizards of the Coast LLC. Spellstash is not affiliated with, endorsed by, or sponsored by Wizards of the Coast LLC. Card data and images are displayed in the Service for the personal collection-management use of the account holder.

7. Subscription Plans and Payments

7.1 Tiers. The Service is offered in a Free tier and a paid Pro tier. The Free tier provides limited access to features (including a hard cap on the number of containers and the number of card instances). Pro unlocks higher limits and the AI-vision card-scan feature. Current limits and the Pro price are listed on the spellstash.com homepage.

7.2 Pro pricing. Pro is offered at $4.99 per month, billed monthly in advance. Annual billing may also be offered at a reduced effective rate; if you choose annual billing, the annual amount is charged in advance for the full twelve-month term.

7.3 Scan-credit add-ons. Pro accounts include 200 AI-vision card scans per billing cycle, refreshing each renewal. If you need more scans within a cycle, you may purchase additional scan packs (200 scans for $2.00 each, one-time charge). Purchased scans roll over and do not expire while your account remains in good standing.

7.4 Billing. All prices are in U.S. dollars (USD). Payment processing is handled by Stripe, Inc. By subscribing to Pro or purchasing a scan pack, you authorize Stripe to charge your selected payment method for the applicable amount and (for subscriptions) on a recurring basis until you cancel.

7.5 Auto-renewal. Pro subscriptions automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. We will not provide advance renewal notice beyond what is stated in these Terms.

7.6 Cancellation. You may cancel your Pro subscription at any time from the Account section of the Service or by contacting info@spellstash.com. Cancellation takes effect at the end of the current billing period. You retain Pro access until the period ends, then revert to the Free tier.

7.7 Refunds. Subscription fees and scan-pack purchases are generally non-refundable. If you believe you were charged in error, contact info@spellstash.com within 7 days of the charge and we will review the request on a case-by-case basis.

7.8 Price changes. We may change subscription pricing at any time. If we increase the price of your current plan, we will notify you at least 30 days before the change takes effect. The new price applies at your next billing cycle following the notice period. If you do not agree to the new price, you may cancel before it takes effect.

7.9 Free tier limits. Free accounts are subject to caps on containers and card instances. We may modify Free tier limits at any time without notice.

7.10 Downgrades. If you downgrade from Pro to Free, features exclusive to Pro (including card scan) become inaccessible. Existing data exceeding the Free tier limits is preserved but may become read-only until your usage falls within the Free limits.

8. Termination

We may suspend or terminate your account and your access to the Service at our discretion, with or without notice, for conduct we determine violates these Terms or is harmful to the Service, other users, or third parties. Upon termination your right to use the Service ends immediately. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and dispute-resolution provisions — survive termination.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR COMPLETENESS OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SPELLSTASH OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR LOSS OF GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00 USD).

11. Indemnification

You agree to indemnify, defend, and hold harmless Spellstash and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: your use of the Service; your violation of these Terms; your violation of any applicable law or regulation; or your violation of any third party's rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to these Terms or the Service will first be addressed through good-faith negotiation. If negotiation fails, the dispute will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the arbitration seated in Broward County, Florida. You waive any right to a jury trial and any right to participate in a class action.

13. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spellstash regarding the Service and supersede all prior or contemporaneous agreements, representations, and understandings.
